General Terms & Conditions
These General Terms and Conditions (hereinafter, "Terms") govern access to and use of the website www.azulcatamaran.com, as well as the booking and provision of catamaran experience services offered by Azul Ventures 2022 SL (hereinafter, "Azul Catamaran" or "the Provider"), in accordance with applicable Spanish legislation.

2. Purpose
Azul Catamaran offers luxury catamaran sailing experiences in the waters of Mallorca, including day trips, sunset cruises, and private charters. The service constitutes a manned nautical charter as defined by Articles 307 to 313 of Spanish Maritime Navigation Act 14/2014. These Terms govern the booking, contracting, and provision of such services.
3. Booking Process
Bookings can be made through our website, by telephone, or by email. By making a booking, the client accepts these Terms in full. The contract is perfected upon booking confirmation and payment of the corresponding deposit. The client will receive an electronic booking confirmation in accordance with e-commerce regulations.
4. Payment Terms
A deposit of 50% of the total price is required to confirm a booking. The remaining 50% must be paid at least one month (30 calendar days) before the experience date. Should the outstanding balance not be received within the stated period, Azul Catamaran reserves the right to cancel the booking, retaining the initial deposit as compensation for damages. All prices include VAT (21%).
5. Right of Withdrawal
In accordance with Article 103(l) of Royal Legislative Decree 1/2007 approving the consolidated text of the Spanish General Consumer and User Protection Act (LGDCU), the right of withdrawal does not apply to contracts for the provision of leisure services where the contract specifies a particular date or period of performance. As these are nautical experiences with a specific date, the client acknowledges and accepts that the 14-day withdrawal right provided for in Article 102 of the LGDCU does not apply.
6. Cancellation Policy
No cancellations or refunds are permitted once the booking is confirmed. All bookings are final and non-transferable. However, in the event of adverse weather conditions preventing safe navigation (see clause 10), a free date change will be offered.
7. Services Included in the Base Price
All experiences include: access to the catamaran with captain and professional crew, snorkelling equipment, water slides, trampoline nets, professional sound system, and full access to all three decks of the catamaran.
8. Optional Services (Add-ons)
The following services are available as optional add-ons at additional cost and are not included in the base price:
- Open bar: Unlimited drinks service (beer, wine, sangria, soft drinks, water). Option to upgrade to premium cocktails and champagne.
- Gourmet catering: Mediterranean buffet lunch or gourmet tapas, with vegetarian, vegan, and gluten-free options.
- Professional DJ: Live DJ with professional sound equipment.
- Custom decoration: For private events, weddings, and celebrations.
Optional add-ons must be booked at least 7 days before the experience date. Add-on prices will be communicated to the client prior to booking.
9. Capacity and Maritime Safety
The catamaran has a maximum capacity of 98 passengers. For groups exceeding 12 persons, the vessel holds commercial passenger certification in accordance with Spanish and European maritime regulations. All passengers must comply with safety instructions provided by the captain and crew. Azul Catamaran reserves the right to deny boarding to any person deemed a safety risk, in a state of manifest intoxication, or failing to comply with on-board conduct rules.
10. Weather Conditions and Force Majeure
Experiences are subject to favourable weather conditions for safe navigation. The captain's decision on navigation viability is final and binding on all matters of maritime safety, in accordance with Maritime Navigation Act 14/2014. Should the captain determine it is not safe to sail, Azul Catamaran will offer a free date change, subject to availability. No refunds will be issued for weather conditions; only rescheduling will be offered. In duly accredited cases of force majeure, the provisions of Article 1,105 of the Spanish Civil Code shall apply.
11. Client Obligations
- Comply with the captain's and crew's safety instructions at all times.
- Do not bring outside food or beverages on board without prior authorisation.
- Maintain responsible and respectful behaviour towards other passengers, crew, and the vessel.
- Inform in advance of any relevant medical conditions, food allergies, or special needs.
- Report to the captain any damage or incident that may affect the safety or seaworthiness of the vessel, in accordance with Article 311 of the Maritime Navigation Act.
12. Liability and Insurance
Azul Catamaran holds mandatory civil liability insurance in accordance with Royal Decree 607/1999 and applicable maritime regulations. The vessel holds all safety and seaworthiness certificates required by current legislation. Azul Catamaran is not responsible for personal items lost or damaged during the experience. Passengers participate in water activities (swimming, snorkelling, water slides) at their own risk.
13. Personal Data Protection
Personal data processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights (LOPDGDD). Data provided will be processed for the purpose of managing the booking and provision of the contracted service. For further information, please consult our Privacy Policy.
14. Intellectual and Industrial Property
All website content (texts, images, logos, graphic design, source code) is the property of Azul Ventures 2022 SL or its licensors and is protected by applicable intellectual and industrial property laws. Reproduction, distribution, or transformation without express authorisation is prohibited.
15. Dispute Resolution
For the out-of-court resolution of disputes arising from electronic contracting, the client may access the European Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.
16. Applicable Law and Jurisdiction
These Terms are governed by Spanish law, in particular Maritime Navigation Act 14/2014, Royal Legislative Decree 1/2007 (LGDCU), Act 34/2002 (LSSI-CE), and the Civil Code. For any dispute that cannot be resolved amicably, the parties submit to the Courts and Tribunals of Palma de Mallorca, without prejudice to any mandatory jurisdiction that may apply to the consumer under current legislation.
